1. BASIC DEFINITIONS

1.1 Terms and Conditions

1.4 Tour Confirmation

https://www.worldee.com/doc/privacy-policy

2. SUBJECT MATTER AND CONCLUSION OF THE CONTRACT

2.1

Under the Contract, we shall arrange a tour for you and you undertake to pay the total price of the tour.

2.2

The Contract is concluded remotely by electronic means through the Portal. You bear the costs of using means of distance communication yourself. These costs do not differ from the basic rate for the use of such means.

2.3

The Contract may be concluded in the Czech language.

2.4

Before submitting an order, you will be provided with pre-contractual information about the tour on the Portal, including a standard information form in accordance with the applicable legislation.

2.5

On the Portal, you select a tour and its date, fill in the order form, check the correctness of all data, read these Terms and Conditions and the Privacy Policy, and click the Order and Pay button.

2.6

By submitting an order, you make a binding proposal to conclude the Contract. After receiving the order, we will send you a confirmation of its receipt. The Contract is concluded only at the moment when we send you an e-mail confirmation that we accept your proposal.

2.7

After the conclusion of the Contract, we will send you in particular:

  • tour confirmation,
  • summary of basic tour information,
  • proof of insolvency protection,
  • these Terms and Conditions,
  • any other travel documents and information.

2.8

There may be cases where we are unable to confirm the order proposal, in particular due to a technical error, exhaustion of capacity, cancellation of the tour, failure to reach the minimum number of participants, or other objective obstacles. In such a case, we will inform you without undue delay.

3. TOUR CONDITIONS

3.1

The basic characteristics of the tour, in particular the destination, duration, transport, accommodation, meals and other services, are set out in the tour description on the Portal and in the tour confirmation.

3.2

If participation in the tour is subject to special requirements, in particular age, health or other requirements, these requirements will be stated in the tour description on the Portal or in the tour confirmation.

3.3

The minimum number of persons required for the tour to take place, if set, is stated in the tour description on the Portal or in the tour confirmation. If this minimum number is not reached, we have the right to cancel the tour within the time limits set by the applicable legislation or the tour confirmation.

4. PRICE AND PAYMENT TERMS

4.1

The tour price is stated on the Portal and in the tour confirmation as the final price including taxes and mandatory fees, unless expressly stated otherwise.

4.2

Certain payments that cannot reasonably be calculated before the conclusion of the Contract may be listed separately, in particular local tourist taxes, accommodation taxes or similar mandatory payments. If such payments are not included in the tour price, they will be stated in the tour description or in the tour confirmation.

4.3

Unless we specify otherwise for a particular tour, the following payment regime applies:

  • the deposit amounts to 25% of the total tour price and is payable upon conclusion of the Contract,
  • the balance of the tour price is payable no later than 30 days before the start of the tour.

4.4

For tours concluded within a period shorter than the deadline for the balance payment, the entire tour price may be payable in a single payment upon conclusion of the Contract.

4.5

The specific amount of the deposit, the due date of the balance payment or any different rules for a particular tour will always be stated in the tour confirmation. However, these rules are always based on these Terms and Conditions.

4.6

Payment can be made by credit card, bank transfer or any other method indicated on the Portal.

4.7

If you pay through a payment gateway, the technical processing of the payment is also governed by the terms and conditions of the payment service provider. These terms and conditions govern only the payment service and do not in any way limit your rights under the travel Contract.

4.8

If you use the payment service of Stripe, the terms and conditions of this service are available at:
https://stripe.com/legal/end-users

5. CHANGE OF TOUR PRICE

5.1

The tour price may be increased only if this right is expressly agreed in the Contract and only as a direct consequence of changes in:

  • transport prices resulting from changes in fuel prices or other energy sources,
  • the amount of taxes or fees related to the travel services included in the Contract,
  • the exchange rate of the Czech koruna used to determine the tour price.

5.2

We will inform you of the price increase in text form in a clear and comprehensible manner no later than 20 days before the start of the tour, including the justification and method of calculation.

5.3

If there is a reduction in the costs referred to in Article 5.1 after the conclusion of the Contract and before the start of the tour, you are entitled to a corresponding reduction in the tour price. We may deduct only the actual administrative costs, which we will substantiate to you upon request.

5.4

If the price increase exceeds 8% of the total tour price, you may accept the proposed change or withdraw from the Contract without paying a cancellation fee within the period we set for you, which shall not be shorter than 5 days.

6. ASSIGNMENT OF THE CONTRACT

6.1

You may assign the Contract to another person who meets the conditions of participation in the tour.

6.2

Notice of the assignment of the Contract must be delivered to us in text form with reasonable advance notice before the start of the tour. Notice delivered no later than 7 days before the start of the tour shall be considered timely.

6.3

Both you and the new customer are jointly and severally liable for the payment of the tour price and for the reimbursement of costs associated with the assignment.

6.4

Only actual costs may be associated with the assignment of the Contract, in particular fees charged by the carrier, accommodation provider or other service providers. These costs must not be disproportionate and must not exceed the costs actually incurred. We will substantiate the amount to you upon request.

7. WITHDRAWAL FROM THE CONTRACT BY THE CUSTOMER

7.1

You may withdraw from the Contract at any time before the start of the tour.

7.2

If you withdraw from the Contract without a statutory reason for withdrawal without a cancellation fee, you may be obliged to pay a cancellation fee (cancellation charge). The amount of the cancellation fee is stated in the tour confirmation or in the tour description on the Portal.

7.3

We set the cancellation fee proportionately, taking into account the time remaining before the start of the tour, the expected cost savings and the expected income from alternative use of the travel services. We will justify the amount of the cancellation fee to you upon request.

7.4

You may withdraw from the Contract without paying a cancellation fee if:

  • there is a significant change to any of the essential elements of the tour,
  • you do not agree with the alternative solution under these Terms and Conditions,
  • unavoidable and extraordinary circumstances occur at the destination of the trip or stay or in its immediate vicinity that have a significant impact on the provision of the tour or the transport of persons to the destination.

7.5

In cases where you withdraw from the Contract and you are entitled to a refund of payments made without a cancellation fee, we will refund all payments received without undue delay, no later than 14 days from the termination of the Contract.

7.6

Please note that the general right of a consumer to withdraw from a distance contract without giving a reason within 14 days generally does not apply to travel contracts.

8. CANCELLATION OF THE TOUR AND AMENDMENT OF THE CONTRACT BY THE ORGANISER

8.1

Before the start of the tour, we may unilaterally amend the terms of the Contract only if we have reserved this right, the change is insignificant and we notify you in a clear, comprehensible and prominent manner in text form.

8.2

If we are forced to make a significant change to any of the essential elements of the tour before the start of the tour or we cannot fulfil special requirements that we have accepted, we will inform you without undue delay and offer you:

  • the proposed amendment to the Contract,
  • an alternative tour, if possible,
  • the option to withdraw from the Contract without a cancellation fee.

8.3

If you withdraw from the Contract for the reasons set out in Article 8.2 and do not accept an alternative tour, we will refund all payments made without undue delay, no later than 14 days from the termination of the Contract.

8.4

If, after the start of the tour, we are unable to provide a substantial part of the services in accordance with the Contract, we will offer you a suitable alternative solution at no additional cost.

8.5

If the alternative solution results in a reduction in the quality or price of the tour, you are entitled to an appropriate price reduction.

8.6

If we cancel the tour before its commencement, you are entitled to a refund of all payments made. The right to compensation for damages is governed by the applicable legislation.

9. COMPLAINTS, LIABILITY AND ASSISTANCE IN DIFFICULTIES

9.1

We are responsible for the proper provision of all travel services included in the Contract, regardless of whether they are to be provided by us or by other providers.

9.2

If you discover a defect during the tour, you are obliged to report it without undue delay to the Travel Buddy or to us through the contacts provided in the tour confirmation, travel documents or in these Terms and Conditions.

9.3

If possible, we will remedy the defect without undue delay.

9.4

If you find yourself in difficulties during the tour, we will provide you with assistance without undue delay, in particular:

  • appropriate information about health services, local authorities and consular assistance,
  • assistance with distance communication,
  • assistance in finding an alternative travel solution.

9.5

We are entitled to claim reasonable reimbursement of costs for the assistance provided if you caused the difficulties intentionally or through negligence.

9.6

Complaints and claims can be made at the e-mail address info@worldee.com or in writing at the mailing address stated in these Terms and Conditions. We will confirm receipt of the complaint.

9.7

Information about internal complaint handling procedures and the contact point at the place of stay will be communicated to you in the tour confirmation or travel documents.
